By accessing or using Arguably (the “Service”), creating an account, or clicking “Continue” on the login page, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and the operator of Arguably (“we”, “us”, or “our”).
Arguably is a fictional conversation game in which you talk with AI characters in scripted emotional scenarios. Every character is generated by artificial intelligence and is not a human. Characters are written to stay in role and may not acknowledge being AI inside the story; the game itself labels them as AI. The characters, situations, and outcomes are fictional, and AI-generated replies can be wrong, inconsistent or unexpected. Nothing in the Service is professional advice of any kind (legal, medical, psychological, financial, or otherwise), and it is not therapy or a substitute for talking to a real person. Any resemblance to real persons, living or dead, is coincidental.
You must be at least 18 years old to use the Service, wherever you live. AI characters in emotional situations may not be suitable for minors. We ask your age before your first game, and you agree to give it truthfully. We will close any account we learn belongs to someone under 18.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@arguably.ai if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behaviour, or pose a security risk. You may not create multiple accounts to circumvent bans, session limits, rate limits, or leaderboard restrictions. Your display name and profile picture appear on the leaderboard to other signed-in players.
Messages you send during gameplay (“User Content”) are processed in real time by our AI systems to generate character responses and compute your score. You retain ownership of your User Content. By submitting User Content, you grant us a limited, worldwide, non-exclusive licence to process and store it, and to send it to our AI provider, for the purpose of operating, securing and fixing the Service, as described in our Privacy Policy. This licence ends when you delete your account, except for copies we must keep by law.
We do not use your User Content to train AI models, and we will not start without first asking for your separate consent. We will never publish your conversations or show them to other players.
You agree not to use the Service to: (a) generate or transmit content that is unlawful, harassing, threatening, defamatory, obscene, or otherwise objectionable; (b) attempt to reverse-engineer, scrape, or extract the scoring algorithm, prompts, or model weights; (c) abuse or overload the API, or use automated tools to interact with the Service; (d) impersonate another person or entity; (e) engage in any activity that violates applicable law, including data protection, export control, or intellectual property law. We may remove content and suspend accounts that breach these prohibitions without prior notice.
If a message suggests you may be thinking about suicide or self-harm, the game pauses that turn and shows crisis helpline information instead of a character reply. This check is automatic and will not catch everything; Arguably cannot provide emergency help. If you or someone else is in danger, contact your local emergency services. How this works is described on our Safety page. You can report any session you think went wrong from inside the game.
All game content, including characters, scenarios, scoring logic, visual design, and software, is owned by or licensed to us and is protected by intellectual property law. You may not copy, reproduce, distribute, or create derivative works of any part of the Service without our prior written consent. Your feedback and suggestions about the Service may be used by us freely without any obligation to you.
The Service relies on service providers including the AI engine behind our characters, Google (sign-in), Neon (database hosting), Vercel (website hosting), Railway (API hosting), Cloudflare (network), Resend (email delivery) and Dodo Payments (payments). Your use of the Service is also subject to those providers' terms and policies where they apply to you directly. We are not responsible for the availability or conduct of these providers.
Paid plans are sold through Dodo Payments, which acts as our Merchant of Record: Dodo is the seller of record for your purchase, processes your payment, and calculates and collects any applicable sales tax, VAT or GST. Your purchase is also subject to Dodo's buyer terms. Prices include any applicable tax. A subscription keeps the price it started at for as long as it stays active, including a launch price. Subscriptions renew automatically until cancelled; you can cancel from your account settings and keep access until the end of the paid period. Refunds follow our Refund Policy. Payment records are kept for as long as tax and accounting law requires. For payment-related queries, contact support@arguably.ai.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. We are in active development and the Service may change or be unavailable without notice.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Service. Our total liability for any claim arising under these Terms shall not exceed the greater of the fees you paid us in the 12 months preceding the claim, or INR 5,000. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law that applies to you. Some jurisdictions do not allow limitations on implied warranties or on liability for incidental or consequential damages, so parts of this section may not apply to you.
To the extent permitted by law, you agree to indemnify us against claims, losses and reasonable legal costs arising from your User Content or your breach of these Terms.
You may delete your account at any time from your profile settings; deletion is immediate and permanent. We may suspend or terminate your access at any time for any reason, including breach of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 7, 10, 11, and 13 survive termination.
Arguably is an independent project operated from India. These Terms are governed by the laws of India, and the courts of India have jurisdiction over disputes arising from them. Please contact us at support@arguably.ai first. We will always try to resolve a problem informally. If you use Arguably as a consumer outside India, you keep the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in your local courts or use your local consumer authority. In India, you may also approach the National Consumer Helpline (1800-11-4000) or a Consumer Commission under the Consumer Protection Act 2019.
We may update these Terms from time to time. When we do, we will update the date at the top of this page and, for material changes, notify you by email or in-app notice. For material changes we will ask you to accept the updated Terms in the app. If you do not agree, you can stop using the Service and delete your account from your profile settings.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right under these Terms is not a waiver of that right. These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements. You may not assign these Terms without our consent; we may assign them freely.
